## Discharges Were Less Common Than in the Service

8 of the 16 convicted enlisted members received a bad-conduct or dishonorable discharge (50%). Across the Navy and Marine Corps, the share was 66%. 4 of the 8 were dishonorable discharges.

For enlisted members, a punitive discharge is a bad-conduct or dishonorable discharge. A sentence without one does not rule out a later administrative separation.

## Confinement

16 cases ended in a conviction, and 15 of those sentences included confinement. The median confinement was 6 months, shorter than the 7-month median across the Navy and Marine Corps. Among the sentences with confinement, a quarter were 11 months or longer.

These are adjudged sentences, set at trial before any plea-agreement cap, clemency, or appeal. Each one covers every charge in the case.

## An NCO-Heavy Group of Accused

By rank, the accused were 6 junior enlisted members and 12 NCOs. No officers were tried. That mix is more senior than in the Navy and Marine Corps as a whole.

Special courts-martial heard 10 cases and general courts-martial heard 8\. The general share of 44% was about the same as the 45% service-wide. A special court-martial caps confinement at one year and cannot impose a dishonorable discharge.

## Pleas

12 accused pleaded guilty and 6 contested. A contested case has a not-guilty or mixed plea to at least one charge. The contested share of 33% compares with 28% across the Navy and Marine Corps. 2 of the 6 contested cases that reached a verdict ended in a full acquittal.

## Quantico and Bremerton

Quantico, Virginia tried 21 cases in 2018, with a median confinement of 11 months and a punitive discharge rate of 56%. Bremerton, Washington tried 28 cases, with a median of 6 months, the same as at Yokosuka, and a rate of 46%. At Bremerton, 18% of cases were contested.

## What the 2018 Records Leave Out

These trials came before the Military Justice Act of 2016 took effect on January 1, 2019\. Navy and Marine Corps records before December 2020 often omit the plea and forum. Cases resolved by nonjudicial punishment, administrative separation, or no action are not included, and the records do not describe the evidence or the plea terms.
