Based on 18 cases · 2013–2018 · Navy and Marine Corps records · data updated October 24, 2026

## Punitive Discharges More Often Than Across the Services

A punitive discharge followed 76% of enlisted convictions here: 8 bad-conduct and 5 dishonorable. In Navy and Marine Corps Article 107 cases in 2013–2018, the share was 60%.

A punitive discharge is a bad-conduct or dishonorable discharge. A sentence without one does not rule out a later administrative separation.

## False Statements Charged With Other Offenses

Article 128 (assault) was charged alongside Article 107 in 9 cases. Article 92 (orders violation) appeared in 5, Article 120 (sexual assault) in 4, Article 121 (larceny) in 3, and Article 81 (conspiracy) in 2.

Across the Navy and Marine Corps, 25 of 243 Article 107 cases charged Article 107 by itself. Each sentence covers every charge in the case, so the companion charges matter when reading the sentence figures.

## Confinement in All 17 Convictions

Of the 18 cases, 17 ended in a conviction on at least one charge, and all 17 sentences included confinement (100%). The median was 5 months, close to the 6 months median in Navy and Marine Corps Article 107 cases. A quarter of the terms were 2 years or longer.

These are adjudged sentences, before any plea-agreement cap, clemency, or appeal.

## Most Accused Pleaded Guilty

The records show 14 guilty pleas and 4 contested cases. The contested share was 22%, compared with 27% in Navy and Marine Corps Article 107 cases. A contested case is one where the accused pleads not guilty to at least one charge.

## NCOs Made Up Most of the Accused

NCOs were 67% of the accused, and junior enlisted members (E-1 to E-4) were 33%. No officers appear. In Navy and Marine Corps Article 107 cases overall, junior enlisted members were 47%.

General courts-martial made up 44% of these cases (8 of 18). The rest were special courts-martial, which cap confinement at one year and cannot impose a dishonorable discharge.

## Trials by Year

The trials ran from April 2013 through November 2018: 5 in 2013, 4 in 2014, 2 in 2015, 3 in 2016, 3 in 2017, and 1 in 2018\. They were 19% of the 96 courts-martial at Yokosuka, Japan in those years.

All came before the Military Justice Act of 2016 took effect on January 1, 2019\. That law later set fixed panel sizes, created judge-alone special courts-martial, and brought in written plea agreements.

## What These Records Leave Out

Nonjudicial punishment, administrative separations, and cases with no action are not in these records. The records do not describe the evidence or the plea terms. Navy and Marine Corps records before December 2020 often omit the plea and forum, so plea counts use only the records that list them.
