Based on 15 cases · 2017 · Navy and Marine Corps records · data updated October 24, 2026

## Few Punitive Discharges

Among 13 enlisted members convicted, 3 received a bad-conduct or dishonorable discharge. The 23% rate was lower than the 68% across the Navy and Marine Corps. 1 of the 3 was a dishonorable discharge.

1 officer or warrant officer was convicted and was dismissed, the officer equivalent of a punitive discharge. A sentence without a punitive discharge does not rule out a later administrative separation.

## False Statements and Orders Violations

All 15 records list the charges. Article 107 (false official statements) and Article 92 (failure to obey an order or regulation) each appeared in 6 cases (40%). Across the Navy and Marine Corps, those shares were 11% and 16%.

Drug charges under Article 112a appeared in 4 cases (27%), compared with 31%. Article 128 (assault) appeared in 3 cases (20%), lower than the 37% across the Navy and Marine Corps. Article 121 (larceny) appeared in 2 cases (13%), compared with 9%. Article 87a (resisting apprehension, numbered since 2019) and Article 89 (disrespect toward a superior officer) each appeared in 1 case. A case with several articles counts under each.

## Shorter Confinement

Of 14 convictions, 10 carried confinement. The median confinement was 3 months, shorter than the 8 months across the Navy and Marine Corps. A quarter of the confinement sentences were 8 months or longer.

These are adjudged sentences, before any plea-agreement cap, clemency, or appeal. Each one covers every charge in the case.

## Mostly Special Courts-Martial

There were 3 general courts-martial and 12 special courts-martial. The general share, 20%, was lower than the 44% across the Navy and Marine Corps. A special court-martial caps confinement at one year and cannot impose a dishonorable discharge.

Among the accused with rank recorded, 7 were NCOs, 6 were junior enlisted members, and 1 was an officer. This group was more senior than all Navy and Marine Corps cases in 2017.

Twentynine Palms, California tried 20 cases in 2017 and Pearl Harbor, Hawaii tried 21\. Both had a median confinement of 6 months, compared with 3 months at Quantico. Their punitive discharge rates were 80% and 72%, both higher than Quantico's 23%.

## Rules and Gaps in the Records

These trials came before the Military Justice Act of 2016 took effect on January 1, 2019, which later set fixed panel sizes and brought in written plea agreements.

Navy and Marine Corps records before December 2020 often omit the plea, so this page gives no contested share or acquittal figures. The records do not describe the evidence or the plea terms. Nonjudicial punishment, administrative separations, and cases closed without action are not included.
