Based on 13 cases · 2013 · Navy and Marine Corps records · data updated October 24, 2026

## More General Courts-Martial

General courts-martial made up 8 of the 13 cases (62%). Across the Navy and Marine Corps in 2013, the share was 37%. A general court-martial can impose any lawful sentence, including long confinement and a dishonorable discharge or dismissal. A special court-martial caps confinement at one year and cannot impose a dishonorable discharge.

The accused were also more senior than in the rest of the Navy and Marine Corps. By rank, 7 were NCOs, 5 were junior enlisted members, and 1 was an officer.

## Confinement After Conviction

There were 12 convictions, and confinement was part of 92% of them. The median confinement was 8 months, compared with 6 months across the Navy and Marine Corps. A quarter of the sentences with confinement were 11 months or longer.

These are adjudged sentences, as imposed at trial before any plea-agreement cap, clemency, or appeal. Each sentence covers every charge in the case.

## Bad-Conduct and Dishonorable Discharges

A punitive discharge followed 73% of enlisted convictions: 7 bad-conduct discharges and 1 dishonorable discharge. The share across the Navy and Marine Corps was 64%. The 1 convicted officer or warrant officer was not dismissed. A sentence without a punitive discharge does not rule out a later administrative separation.

## Charges

All 13 records list the charges. Article 128 (assault) was the most common, in 5 cases (38%), the same share as across the Navy and Marine Corps. Article 134 (general article), Article 120 (rape and sexual assault), and Article 92 (failure to obey an order or regulation) each appeared in 4 cases (31%).

Those 3 articles were charged more often here than across the Navy and Marine Corps, where the shares were 17%, 22%, and 22%. Article 121 (larceny) appeared in 3 cases (23%). A case with several articles counts under each.

## The Rules in 2013 and Record Limits

These trials came before the Military Justice Act of 2016 took effect on January 1, 2019\. That law later set fixed panel sizes, created judge-alone special courts-martial, and brought in written plea agreements. None of that applied to these cases.

The records give trial dates, not offense dates. They do not describe the evidence or the plea terms, or show nonjudicial punishment and administrative separations.
