Based on 11 cases · 2019–2023 · Navy and Marine Corps records · data updated October 24, 2026

## What Was Being Attempted

Article 80 makes an attempt to commit another offense a crime, so it is usually charged with other articles. Only 2 of the 11 cases charged Article 80 alone. Article 120b (child sexual abuse) was charged in 5 cases, Article 128 (assault) in 3, Article 134 (general article) in 2, Article 120 (sexual assault) in 2, and Article 107 (false official statement) in 1.

The sentence in each case covers every charge, so these other charges are part of the sentence figures below.

## Punitive Discharges in 9 of 10 Convictions

Of 10 convicted enlisted members, 9 received a punitive discharge: 5 bad-conduct discharges and 4 dishonorable discharges. In all Navy and Marine Corps Article 80 cases in 2019–2023, the share was 82%.

A sentence without a punitive discharge does not rule out a later administrative separation, which these records do not cover.

## Confinement

Of the 11 cases, 10 ended in a conviction on at least one charge, and 9 of those sentences included confinement (90%). The median confinement was 1.5 years, longer than the 1.2 years median in all Navy and Marine Corps Article 80 cases. Among the sentences that included confinement, a quarter were 3 years or longer.

These are adjudged sentences, set at trial before any plea-agreement cap, clemency, or appeal.

## Fewer Contested Cases Than Before 2019

Of the 11 accused, 9 pleaded guilty and 2 contested at least one charge (18%). A case is contested when the accused pleads not guilty to at least one charge. In all Navy and Marine Corps Article 80 cases in 2019–2023, the contested share was 30%. At Pearl Harbor in 2013–2018, it was 55%.

Of the 2 contested cases that reached a verdict, 1 ended in a full acquittal. In 2013–2018, 2 of 6 did.

## 2013–2018 and 2019–2023 Side by Side

Both periods had 11 cases. The earlier cases came over 4 years with cases on record, about 3 a year. The later ones came at about 2 a year: 2 in 2019, 3 in 2020, 2 in 2021, 2 in 2022, and 2 in 2023\. They were 28% of the 39 courts-martial at Pearl Harbor in 2019–2023.

The median confinement was 1.2 years before 2019 and 1.5 years after. General courts-martial went from 73% to 82%. With 11 cases in each period, a single case can move these figures, so they show a direction only.

| | 2013–2018 | 2019–2023 |
| ----------------------------------- | --------- | --------- |
| Cases | 11 | 11 |
| Contested (of pleas recorded) | 55% | 18% |
| Full acquittals (decided contested) | 2 of 6 | 1 of 2 |
| Convictions with confinement | 8 of 9 | 90% |
| Median confinement | 1.2 years | 1.5 years |
| Punitive discharge (enlisted) | 8 of 9 | 90% |
| General courts-martial | 73% | 82% |

## Rank and Court Level

NCOs made up 55% of the accused, junior enlisted members (E-1 to E-4) 45%, and officers 0%. Across all Navy and Marine Corps Article 80 cases, junior enlisted members were 57%.

General courts-martial heard 9 of the 11 cases (82%), compared with 76% service-wide. A special court-martial caps confinement at one year and cannot impose a dishonorable discharge.

## Gaps in the Records

The records show charges, pleas, findings, and sentences. They do not show the evidence, the plea terms, or conduct handled outside a court-martial. Navy and Marine Corps records before December 2020 often omit the plea.
