Article 134 (general article) also appeared in 5 cases, the same as its 22% share for the year.

## More Contested Cases

A case is contested when the accused pleads not guilty to at least one charge. In November 2023, 9 cases were contested and 14 ended in guilty pleas. That makes 39% of cases with a plea recorded contested, compared with 32% across 2023.

Few contested cases ended in a full acquittal. The comparison table shows that 1 of the 9 contested cases that reached a verdict ended in a full acquittal.

## Many Convictions Without Confinement

Of the 23 cases, 22 ended in a conviction on at least one charge. Of those 22 sentences, 15 included confinement (68%). The other 7 convictions had no confinement (32%), compared with 21% for the year.

The median confinement was 6 months, the same as for the Navy and Marine Corps in 2023\. A quarter of the sentences with confinement were 3 years or longer. These are adjudged sentences: the sentence announced at trial, before any plea-agreement cap, clemency, or appeal, covering every charge in the case.

## A Few Long Sentences

Sentences longer than one year came in 5 of 22 convictions (23%), the same share as for 2023\. Of those, 2 were 5 years or more (9%), compared with 4% for the year. The other 3 were more than 1 year and under 5 years (14%), compared with 19%.

Sentences from 6 months to 1 year made up 14% of convictions, compared with 23%. Sentences under 6 months made up 32%, about the same as the 33% for the year. Only a general court-martial can impose more than one year of confinement. A special court-martial is capped at one year.

## Discharges for Enlisted Members

Of 22 convicted enlisted members, 15 received a bad-conduct or dishonorable discharge (68%). That was higher than the 63% for 2023\. Of the 15, 6 were dishonorable discharges. There were no officers or warrant officers this month.

A sentence without a punitive discharge does not rule out an administrative separation later.

## Junior Ranks and Special Courts-Martial

Of the accused, 18 were junior enlisted (E-1 to E-4) and 5 were NCOs (E-5 to E-9). The group was more junior than for all of 2023, when 65% were junior enlisted.

General courts-martial, which can impose any lawful sentence, made up 8 of the 23 cases (35%), lower than the 46% for the year. The other cases were special courts-martial, which cap confinement at one year and cannot impose a dishonorable discharge.

## Compared With November 2022

November 2022 had 33 cases, and November 2023 had 23\. The contested share went from 26% to 39%, and full acquittals went from 0 of 8 to 1 of 9\. The median confinement went from 5 months to 6 months. Convictions with confinement went from 87% to 68%. Punitive discharges went from 72% to 68%, and general courts-martial went from 42% to 35%.

In a month this small, a single case can change a percentage noticeably, so these comparisons show direction rather than size.

## Installations

Camp Lejeune, North Carolina, tried 5 cases. Bremerton, Washington, and Camp Pendleton, California, tried 3 each. Yokosuka, Japan, and Quantico, Virginia, tried 2 each. These locations account for 65% of the month. Larger installations try more cases of every kind, so a high count alone says nothing about a particular base.

## What the Records Do Not Show

These records include only cases that reached a court-martial. Cases resolved by nonjudicial punishment, administrative separation, or no action are not included. The records do not describe the evidence or plea terms, and they give trial dates rather than offense dates.
