## Other Common Charges Were About the Same as the Year

Assault under Article 128 was the most common article, in 14 cases (33%), about the same as its 34% yearly share. Article 112a (wrongful use, possession of controlled substances) appeared in 11 cases (26%), the same as its share for the year. Article 92 (failure to obey order or regulation) was less common, at 9% compared with 13%.

## Conviction on the Charged Article

For the most common charges, the records show how often the accused was convicted of that article. All 10 Article 80 cases (100%) ended in a conviction under it, and the median confinement was 1.1 years. In 13 of 14 Article 128 cases (93%), the accused was convicted under it, and the median was 9 months. In 10 of 11 Article 112a cases (91%), the accused was convicted under it, and the median was 8 months.

Article 120 ended in a conviction on that article in 8 of 9 cases, and the median was 8.5 years. Because a case can include a conviction on one article and an acquittal on another, the rows overlap.

## More Very Long and No-Confinement Sentences

Of the 44 cases, 40 ended in a conviction on at least one charge, and 31 of those sentences included confinement (78%). The median confinement was 8 months, compared with 7 months for the Navy and Marine Corps for all of 2018\. Sentences here are adjudged at trial, before any plea-agreement cap, clemency, or appeal, and cover every charge in the case.

Sentences of 5 years or more made up 22% of convictions, compared with 9% for the year. Another 9 convictions (22%) included no confinement, compared with 15%. Terms of more than 1 year but under 5 years made up only 10%, compared with 20%. Terms longer than one year were adjudged in 13 of 40 convictions (32%), about the same as 30% for the year.

## Sentences by Court Level

A general court-martial can adjudge any lawful sentence. A special court-martial caps confinement at one year and cannot impose a dishonorable discharge. The month had 21 general and 23 special courts-martial. The general court-martial share was 48%, compared with 45% for the year.

At general courts-martial, 84% of convictions included confinement, and the median was 7 years. At special courts-martial, 71% did, and the median was 6 months.

## Punitive Discharges

Of convicted enlisted members, 59% received a punitive discharge (12 dishonorable and 11 bad-conduct), compared with 66% for 2018\. The month's 1 convicted officer or warrant officer was dismissed. A sentence without a punitive discharge does not rule out a later administrative separation.

## Changes From June 2017

June 2017 had 43 cases, and June 2018 had 44\. The contested share was 25% in both months. Full acquittals in contested cases that reached a verdict went from 2 of 4 to 1 of 4\. Pleas are recorded in only 16 of the 44 cases this month: 12 guilty and 4 contested. Navy and Marine Corps records before December 2020 often omit the plea. The contested share for the year was 28%.

The median confinement fell from 2.5 years to 8 months. Convictions with confinement fell from 92% to 78%. Punitive discharges for convicted enlisted members went from 69% to 59%, and the general court-martial share went from 51% to 48%. In monthly groups this size, a few cases can change a percentage, so the changes show direction, not precise size.

## Rank and Installations

Junior enlisted members (E-1 to E-4) made up 63% of the accused, NCOs made up 34%, and officers made up 2%. The junior enlisted share was about the same as the year's 61%.

Camp Pendleton, California, and Okinawa, Japan, had 8 cases each. Camp Lejeune, North Carolina, and Yokosuka, Japan, had 5 each, and Bremerton, Washington, had 4\. Together they account for 68% of the 44 cases. Larger installations try more cases of every kind.

## Rules of the Time and What Is Missing

These trials came before the Military Justice Act of 2016 took effect on January 1, 2019\. Fixed panel sizes, judge-alone special courts-martial, and written plea agreements did not yet apply.

The records do not show the evidence, any plea terms, or conduct handled by nonjudicial punishment or administrative separation. They give trial dates, not offense dates.
