**Short answer:** From 2021–2024, 15 Navy and Marine Corps courts-martial charged both Article 129 (burglary and unlawful entry) and Article 92 (orders violation). The median confinement was 4 months, shorter than the 8 months in all Navy and Marine Corps Article 129 cases. A punitive discharge followed 46% of enlisted convictions, compared with 66% across those Article 129 cases.

Based on 15 cases · 2021–2024 · Navy and Marine Corps records · data updated October 24, 2026

## Shorter Confinement Than in Article 129 Cases Overall

All 15 cases ended in a conviction on at least one charge. 9 of the 15 sentences included confinement (60%).

The median confinement was 4 months. In all Navy and Marine Corps Article 129 cases in 2021–2024, the median was 8 months. At the same time, a quarter of the confinement terms in this group were 1.2 years or longer.

These are adjudged sentences. They were set at trial, before any plea-agreement cap, clemency, or appeal, and each covers every charge in the case.

## Fewer Punitive Discharges

46% of enlisted convictions included a punitive discharge: 5 bad-conduct discharges and 1 dishonorable discharge. In Navy and Marine Corps-wide Article 129 cases, the share was 66%.

An enlisted sentence with no bad-conduct or dishonorable discharge does not rule out a later administrative separation.

## Contested Cases

Of the cases with a plea recorded, 9 were guilty pleas and 6 were not-guilty or mixed pleas. That makes 40% contested. In Navy and Marine Corps-wide Article 129 cases, the contested share was 37%.

## Charges Listed Together

Article 129 was never the only charge in these cases. In Navy and Marine Corps-wide Article 129 cases, 9 of 66 charged it alone.

Besides Article 92, the most common charges were Article 134 (general article) in 6 cases, Article 107 (false official statement) in 6, Article 121 (larceny) in 5, and Article 128 (assault) in 4.

## Court Level and Rank

General courts-martial made up 40% of these cases (6 of 15), and special courts-martial made up the rest. A general court-martial can impose long confinement and a dishonorable discharge. A special court-martial caps confinement at one year.

Among the accused with rank recorded, 10 were junior enlisted members and 3 were NCOs. No officers were charged. This group is more senior than Navy and Marine Corps Article 129 cases overall.

## When the Trials Happened

The 15 trials took place from January 2021 through May 2024\. There were 8 in 2021, 1 in 2022, 4 in 2023, and 2 in 2024.

## Law Changes and Record Limits

Since December 28, 2023, special trial counsel, not commanders, decide whether to prosecute covered offenses such as sexual assault, domestic violence, and murder. And when every guilty finding is for an offense after December 27, 2023, the military judge sets the sentence within new sentencing parameters. Both rules turn on the offense date, which these records do not give, so the 2024 trials may fall under either set of rules.

These records cover only cases that reached a courtroom. Nonjudicial punishment, administrative separation, and cases with no action are not included. The records also do not describe the evidence or the plea terms.
