**Short answer:** The records show 18 Navy and Marine Corps courts-martial from 2021–2026 that charged Article 128 (assault) together with Article 131b (obstruction). Among 15 convicted enlisted members, 14 received a punitive discharge (93%), compared with 54% in all Navy and Marine Corps Article 128 cases. The median confinement was 1.2 years, compared with 6 months across those Article 128 cases.

Based on 18 cases · 2021–2026 · Navy and Marine Corps records · data updated October 24, 2026

## 93% Received a Punitive Discharge

Of the 15 enlisted members convicted, 14 received a bad-conduct discharge or a dishonorable discharge. 4 of those 14 were dishonorable discharges. In all Navy and Marine Corps Article 128 cases in 2021–2026, 54% of convicted enlisted members received a punitive discharge.

The group also includes 1 convicted officer or warrant officer, who was not dismissed. Dismissal is the officer equivalent of a punitive discharge. A sentence without a punitive discharge does not rule out a later administrative separation.

## Median Confinement of 1.2 Years

17 of the 18 cases ended in a conviction on at least one charge. 15 of those 17 sentences included confinement (88%).

The median confinement was 1.2 years. For all Navy and Marine Corps Article 128 cases, the median was 6 months. A quarter of the confinement terms here were 2 years or longer.

Each figure is an adjudged sentence, set at trial before any plea-agreement cap, clemency, or appeal. The sentence covers every charge in the case, not only the assault and obstruction counts.

## Sexual Assault Charges in the Same Cases

Every case charged at least one other article besides Article 128\. After Article 131b, the most common were Article 92 (orders violation) in 7 cases, Article 120 (sexual assault) in 6, Article 115 (communicating threats) in 5, and Article 107 (false official statement) in 4.

When an assault count appears next to a sexual assault charge, it can describe part of the same incident. The records do not show how the counts in a case relate to each other.

## Court Level

10 of the 18 cases (56%) were general courts-martial, and special courts-martial made up the rest. Only a general court-martial can impose a dishonorable discharge or confinement of more than one year.

## Pleas

In 11 cases the accused pleaded guilty, and in 7 the accused entered a not-guilty or mixed plea. The contested share was 39%, about the same as the 38% in all Navy and Marine Corps Article 128 cases in 2021–2026.

## Rank of Those Charged

Junior enlisted members (E-1 to E-4) were 76% of the accused. NCOs and officers were each 12%. Across all Navy and Marine Corps Article 128 cases in 2021–2026, junior enlisted members were 62%.

## Trials by Year

The cases were tried from February 2021 through August 2026\. There were 7 in 2021, 4 in 2022, 4 in 2023, 0 in 2024, 1 in 2025, and 2 in 2026, a partial year.

## Outside the Trial Records

The records give the trial date, not the date of the offense. They do not describe the evidence or any plea terms. Cases resolved by nonjudicial punishment or administrative separation are not part of this data.
