## Confinement and Discharges

Confinement was part of 14 of the 19 sentences. The median confinement was 6 months, close to the 5 months for the rest of the Navy and Marine Corps. A quarter of the sentences with confinement were 2 years or longer.

Among 18 convicted enlisted members, 11 received a bad-conduct or dishonorable discharge (61%), compared with 58% across the service. 5 of the 11 were dishonorable discharges. These are adjudged sentences, set before any plea-agreement cap, clemency, or appeal.

## Who Was Tried

Junior enlisted members (E-1 to E-4) made up 72% of the accused and NCOs made up 28%. No officers were tried. Across the rest of the Navy and Marine Corps, junior enlisted members were 58%.

There were 7 general and 12 special courts-martial. The general share of 37% was about the same as the 38% service-wide. A special court-martial caps confinement at one year and cannot impose a dishonorable discharge.

## The December 2023 Rules

Since December 28, 2023, special trial counsel, not commanders, decide whether to prosecute covered offenses such as sexual assault, domestic violence, and murder. For offenses after December 27, 2023, the military judge sets the sentence within new sentencing parameters. Because the records give trial dates and not offense dates, 2024 trials include cases under both sets of rules.

## What Is Not in the Records

Nonjudicial punishment, administrative separations, and cases with no action are not included. The records also do not describe the evidence or the plea terms.
