**Short answer:** At Mayport, Florida, 74% of Article 128 (assault) cases in 2019–2023 were contested, compared with 40% in Navy and Marine Corps Article 128 cases overall. 8 of the 14 contested cases that reached a verdict ended in a full acquittal (57%), compared with 49% service-wide and 4 of 13 at Mayport in 2013–2018.

Based on 19 cases · 2019–2023 · Navy and Marine Corps records · data updated October 24, 2026

## Verdicts in Contested Cases

14 of the 19 cases were contested and 5 were guilty pleas. A contested case has a not-guilty or mixed plea. In 2013–2018, 42% of the Mayport cases were contested.

Of the 14 contested cases with a verdict, 8 ended in a full acquittal (57%). 3 more ended in a partial acquittal (21%), meaning not guilty of at least one charge or specification but guilty of another. The full-acquittal rate was higher than the 49% in all Navy and Marine Corps Article 128 cases in 2019–2023.

## Sexual Assault Charges in the Same Cases

8 of the 19 cases charged Article 128 alone, compared with 194 of 574 Navy and Marine Corps Article 128 cases. Article 120 (sexual assault) appeared in 6 cases. Article 133 (conduct unbecoming) and Article 134 (general article) appeared in 2 each, and Article 109 (property damage) and Article 120c (indecent recording and exposure) in 1 each.

When an assault charge appears with a sexual assault charge, the assault count can describe part of the same incident.

## Sentences After a Conviction

11 cases ended in a conviction on at least one charge. 10 of those sentences included confinement (91%). The median confinement was 7 months, close to the 6 months in Navy and Marine Corps Article 128 cases overall and the 8 months at Mayport in 2013–2018\. A quarter of the confinement terms were 9 months or longer.

5 of 9 convicted enlisted members received a punitive discharge. In 2013–2018, 67% did. These are adjudged sentences, before any plea-agreement cap, clemency, or appeal.

## Court Level and Rank

14 of the 19 cases (74%) were tried at a general court-martial, compared with 58% in 2013–2018\. A general court-martial can impose long confinement and a dishonorable discharge.

Among the accused with rank recorded, 14 were junior enlisted members, 2 were NCOs, and 2 were officers. That group is more junior than in Navy and Marine Corps Article 128 cases overall.

## How Many Cases?

The 19 cases were tried from February 2019 through August 2023: 3 in 2019, 7 in 2020, 5 in 2021, 1 in 2022, and 3 in 2023\. They were 28% of the 69 courts-martial at Mayport, Florida in 2019–2023\. In 2013–2018 there were 31 cases over 6 years, about 5 a year, compared with about 4 a year since. With groups this small, the changes show direction only.

## What the Records Leave Out

The records list charges, pleas, findings, and sentences. They do not describe the evidence, the plea terms, or cases handled by nonjudicial punishment. Navy and Marine Corps records before December 2020 often omit the plea, so plea counts use only the records that list one.
