## Many Assault Cases Also Charged Sexual Assault

This post covers every court-martial at Mayport, Florida in 2013–2018 that charged Article 128\. Article 128 was the only charge in 13 of the 31 cases. Article 120 (sexual assault) appeared in 12.

Other additional charges were less common. Article 115 (malingering), Article 86 (AWOL), and Article 112a (drug) each appeared in 2 cases. Article 80 (attempt) appeared in 1\. When an assault charge is filed with a sexual assault charge, the assault charge can describe part of the same incident. The sentence covers the whole case.

## Fewer Full Acquittals Than Elsewhere

Among cases with a plea recorded, 13 were contested and 18 were guilty pleas. A case is contested when the accused pleads not guilty to at least one charge, either fully or through a mixed plea. The contested share was 42%, about the same as the 43% across the Navy and Marine Corps.

Of the 13 contested cases, 4 ended in a full acquittal. Another 3 ended in a partial acquittal, in which the accused was found not guilty of at least one charge and guilty of another. The full acquittal rate was 31%, lower than the 48% in the rest of the Navy and Marine Corps. With only 13 contested cases, a few verdicts either way would change these rates.

## Share of Mayport's Courts-Martial

These 31 cases were 32% of all 97 courts-martial at Mayport in the period. They were tried from February 2013 through April 2018\. The number changed from year to year: 5 in 2013, 7 in 2014, 1 in 2015, 10 in 2016, 5 in 2017, and 3 in 2018.

## General and Special Courts-Martial

General courts-martial were 58% of the cases (18 of 31). Special courts-martial were the rest. A general court-martial can impose any lawful sentence, including long confinement and a dishonorable discharge. A special court-martial caps confinement at one year and cannot impose a dishonorable discharge.

The 2 court levels differed in pleas and sentences. The 18 general courts-martial had a median confinement of 1.2 years, and 56% were contested. The 13 special courts-martial had a median confinement of 3 months, and 23% were contested.

## Confinement Followed Most Convictions

Confinement was part of 89% of the 27 convictions. The median confinement was 8 months, the same as the 8 months median in the rest of the Navy and Marine Corps. A quarter of the confinement sentences were 2 years or longer. These are adjudged sentences, before any plea-agreement cap, clemency, or appeal, and each covers every charge in the case.

Sentences longer than one year were less common than in Navy and Marine Corps Article 128 cases overall: 7 of 27 convictions (26%), compared with 33%. More convictions at Mayport were in the band from 6 months to 1 year: 37%, compared with 23% elsewhere. Fewer were under 6 months: 26%, compared with 34%.

## Punitive Discharges After Conviction

A punitive discharge followed 67% of enlisted convictions here: 11 bad-conduct discharges and 7 dishonorable discharges. Across Article 128 cases in the Navy and Marine Corps, the share was 63%, a little lower. A sentence without a punitive discharge does not rule out a later administrative separation, which these records do not track.

## Who Was Charged

The accused were 16 junior enlisted members (E-1 to E-4) and 15 NCOs (E-5 to E-9). No officers or warrant officers appear. This group is more senior than Article 128 cases across the Navy and Marine Corps in 2013–2018, where 55% of the accused were junior enlisted.

No officers were tried in these cases, so there were no officer dismissals. Every punitive discharge counted here is a bad-conduct or dishonorable discharge.

## The Rules of the Period, and What Is Missing

All of these trials came before the Military Justice Act of 2016 took effect on January 1, 2019\. That law set fixed panel sizes, created judge-alone special courts-martial capped at six months with no punitive discharge, and introduced written plea agreements. None of those changes applied to the cases here.

The records show the charges, pleas, findings, and sentences. Navy and Marine Corps records before December 2020 often omit the plea and forum, so the plea counts use only the records that list one. The records also leave out the evidence, the plea terms, offense dates, and conduct handled outside a court-martial.
