## Fewer Contested Cases

Of the 22 records, 18 list a plea: 14 guilty pleas and 4 not-guilty or mixed pleas. A case is contested when the accused pleads not guilty to at least one charge. The contested share of 22% was lower than the 32% across the Navy and Marine Corps.

None of the 4 contested cases that reached a verdict ended in a full acquittal.

## Confinement

Of 18 convictions, 17 included confinement. The median confinement was 6 months, compared with 7 months across the service. A quarter of the sentences with confinement were 1 year or longer.

These are adjudged sentences, before any plea-agreement cap, clemency, or appeal, and each covers every charge in the case.

## Sentences by Court Level

General courts-martial heard 10 of the 22 cases (45%), and special courts-martial heard 12\. The median confinement was 1.5 years in the general courts-martial and 4 months in the special courts-martial.

A general court-martial can impose any lawful sentence, including a dishonorable discharge. A special court-martial caps confinement at one year and can impose a bad-conduct discharge but not a dishonorable discharge.

## Punitive Discharges

A punitive discharge followed 65% of enlisted convictions: 7 bad-conduct discharges and 4 dishonorable discharges. Across the Navy and Marine Corps, the share was 64%. A sentence without a punitive discharge does not rule out a later administrative separation.

## Compared With 2020

The records list 20 cases in 2020 and 22 in 2021\. Median confinement went from 9 months to 6 months. Convictions with confinement went from 89% to 94%. Punitive discharges for convicted enlisted members went from 56% to 65%.

General courts-martial were 45% of cases in both years. No contested share is available for 2020, because Navy and Marine Corps records before December 2020 often omit the plea. With groups this small, a few cases can move each figure.

| | 2020 | 2021 |

## Rank of the Accused

Among the accused with rank recorded, 15 were junior enlisted members (E-1 to E-4) and 2 were NCOs (E-5 to E-9). No officers were tried. Across the Navy and Marine Corps, 69% of the accused were junior enlisted.

## Mayport and Bremerton

Mayport, Florida tried 24 cases and Bremerton, Washington tried 28 in the same year. Both had higher contested shares: 42% at Mayport and 48% at Bremerton. Full acquittals in contested cases were 2 of 10 at Mayport and 5 of 13 at Bremerton.

The median confinement was 1.5 years at Mayport and 6 months at Bremerton. Punitive discharges for convicted enlisted members were 67% at Mayport and 41% at Bremerton.
