**Short answer:** Fort Stewart held 19 courts-martial charging Article 128 (assault) from March 2021 through December 2023\. 42% were contested, about the same as 41% in Army Article 128 cases overall. 11 of 15 convicted enlisted members received a punitive discharge (73%), compared with 70% Army-wide, and the median confinement was 5 months, the same as the Army median.

Based on 19 cases · 2021–2023 · Army records · data updated October 24, 2026

## Sexual Assault Was the Most Common Companion Charge

Article 128 was the only charge in 6 of the 19 cases, compared with 112 of 455 in Army Article 128 cases overall. Article 120 (sexual assault) appeared in 6 cases. Article 128b (domestic violence) and Article 134 (general article) each appeared in 4, and Article 115 (communicating threats) and Article 90 (disobeying an officer) each in 3.

When assault is charged together with sexual assault or domestic violence, the assault count can describe part of the same incident.

## Contested Cases and Plea Agreements

11 accused pleaded guilty, and 8 contested at least one charge. A contested case has a not-guilty or mixed plea. The contested share was 42%, compared with 41% in all Army Article 128 cases in 2021–2023.

8 of the 11 guilty pleas are recorded with a plea agreement, and 3 have no entry. The records do not show what an agreement said.

## Confinement

Confinement was part of 82% of the 17 convictions. The median was 5 months, the same as across the Army. A quarter of the confinement terms were 1.6 years or longer.

These sentences were adjudged at trial. They include every charge in the case and come before any plea-agreement cap, clemency, or appeal.

## Discharges for Enlisted Members and Officers

Of 15 convicted enlisted members, 11 received a punitive discharge: 8 bad-conduct and 3 dishonorable. In Army Article 128 cases overall, 70% did. 2 convicted officers or warrant officers appear in these cases, and neither was dismissed.

A sentence without a punitive discharge does not rule out a later administrative separation.

## Panels Heard 4 Cases

Members heard 21% of the cases with the forum listed, all 4 of them enlisted panels. A military judge alone decided the other 15\. The accused usually chooses between a military judge alone and a panel of members.

## Rank of the Accused

The accused were 13 junior enlisted members (E-1 to E-4), 4 NCOs (E-5 to E-9), and 2 officers or warrant officers. That mix was more junior than Army Article 128 cases overall, where 57% were junior enlisted.

## Cases by Year

Fort Stewart tried 5 of these cases in 2021, 5 in 2022, and 9 in 2023\. Assault charges appeared in 30% of its 64 courts-martial in 2021–2023\. The services were required to begin publishing trial records under Article 140a by December 2020, and Army records here are sparse before 2021.

## What These Records Leave Out

The records show charges, pleas, findings, and sentences. They do not show the evidence, the plea terms, or conduct handled outside a court-martial.
