**Short answer:** Every enlisted member convicted in the 12 Article 107 (false official statement) courts-martial at Camp Pendleton, California in 2017 and 2018 received a punitive discharge: 10 of 10 (100%). Across all Navy and Marine Corps Article 107 cases in those years, the share was 59%. The median confinement was 7 months, compared with 6 months across the service.

Based on 12 cases · 2017–2018 · Navy and Marine Corps records · data updated October 24, 2026

## A Punitive Discharge in Every Enlisted Conviction

10 enlisted members were convicted, and all 10 received a bad-conduct or dishonorable discharge. 2 of those were dishonorable discharges. The rate across Navy and Marine Corps Article 107 cases in 2017–2018 was 59%.

A punitive discharge is a bad-conduct or dishonorable discharge for an enlisted member. It is part of the court-martial sentence. A separate administrative separation can still follow a sentence that has no punitive discharge.

## What Confinement Did the Convictions Carry?

All 10 convictions included confinement (100%). The median confinement was 7 months. The median across Navy and Marine Corps Article 107 cases in 2017–2018 was 6 months. A quarter of the confinement terms here were 1.1 years or longer.

The figures are adjudged sentences, as announced at trial and before any plea-agreement cap, clemency, or appeal. A sentence covers all the charges in a case.

## Other Charges in the Same Cases

11 of the 12 cases included at least one charge besides Article 107\. Article 92 (orders violation) and Article 112a (drug) each appeared in 4 cases. Article 128 (assault) and Article 131b (obstruction, numbered since 2019) each appeared in 3\. Article 120 (sexual assault) appeared in 2.

Those other charges are part of each sentence in this post.

## Rank and Court Level

Among the accused with rank recorded, junior enlisted members (E-1 to E-4) made up 90% and NCOs made up 10%. No officers appear. Across all Navy and Marine Corps Article 107 cases in 2017–2018, junior enlisted members were 60% of the accused.

3 cases were general courts-martial and 9 were special courts-martial. The general share was 25%, lower than the 40% across the service. A special court-martial caps confinement at one year and can impose a bad-conduct discharge but not a dishonorable discharge.

## Trial Dates

The 12 trials took place from February 2017 through December 2018, with 7 in 2017 and 5 in 2018\. They were 8% of the 149 courts-martial at Camp Pendleton, California in 2017–2018.

## Tried Under the Rules Before 2019

All of these trials came before the Military Justice Act of 2016 took effect on January 1, 2019\. That law later created judge-alone special courts-martial capped at six months with no punitive discharge, set fixed panel sizes, and added written plea agreements. None of those changes applied to these cases.

## Gaps in These Records

Navy and Marine Corps records from before December 2020 often omit the plea, so this post does not report a contested share. The records also do not show the evidence, the plea terms, or offense dates. Cases handled by nonjudicial punishment, administrative separation, or no action are not included.
