**Short answer:** The records hold 14 Army cases from 2021–2026 that charged both Article 80 (attempt) and Article 81 (conspiracy). Confinement was part of 100% of the 13 convictions, with a median of 1.2 years, close to the 1.3 years across all Army Article 80 cases. 11 of the 14 accused pleaded guilty, and the contested share was 21%, against 34% Army-wide.

Based on 14 cases · 2021–2026 · Army records · data updated October 24, 2026

## Confinement in Every Conviction

13 of the cases ended in a conviction, and every one of those 13 sentences included confinement. Half of the terms were 1.2 years or less. Across all Army Article 80 cases, the median was 1.3 years.

The upper end was much longer. Among the sentences with confinement, a quarter were 2.3 years or longer, and 1 was a life sentence.

The figures are adjudged sentences. They come from the trial itself, before any plea-agreement cap, clemency, or appeal, and they reflect every charge in the case.

## Most Accused Pleaded Guilty

11 accused pleaded guilty and 3 contested at least one charge. That contested share, 21%, is lower than the 34% for all Army Article 80 cases. 10 of the 11 guilty pleas are recorded with a plea agreement, and 1 has no entry. Army records say whether an agreement existed but not what it said.

A military judge alone decided guilt in 12 cases. An enlisted panel heard 1 case, and no officer panel heard any. Members heard 8% of the cases here, against 18% in all Army Article 80 cases in 2021–2026.

## Discharges After Conviction

Among 13 enlisted members convicted, 11 received a bad-conduct or dishonorable discharge (85%). 5 of those were dishonorable. The Army-wide share for Article 80 cases was 90%, so a punitive discharge was less common here.

## A Younger Group, Mostly at General Courts-Martial

10 of the accused were junior enlisted (E-1 to E-4) and 4 were NCOs (E-5 to E-9). None was an officer or warrant officer. Across Army Article 80 cases overall, 55% of the accused were junior enlisted.

12 of the 14 cases (86%) were general courts-martial, the level that can impose long confinement and a dishonorable discharge. Special courts-martial made up the rest.

## What Else Was Charged

Article 80 never appeared alone here: 0 of the 14 cases charged it by itself, compared with 59 of 210 Army-wide Article 80 cases. Beyond Article 81, which appears in all 14, the most frequent charges were Article 128 (assault), Article 131b (obstruction), and Article 121 (larceny), each in 5 cases. Article 129 (burglary and unlawful entry) appeared in 3.

## Cases by Year

The 14 trials took place between May 2021 and July 2026\. The yearly counts were 5 in 2021, 5 in 2022, 1 in 2023, 1 in 2024, 0 in 2025, and 2 in 2026, a partial year.

Rule changes took effect in December 2023\. Special trial counsel began deciding whether to prosecute covered offenses, and new sentencing parameters apply when every guilty finding is for an offense after December 27, 2023\. Both depend on offense dates, which these records lack.

## Limits of the Records

The data shows trial dates, charges, pleas, findings, and sentences. It does not show offense dates, the evidence, or plea terms, and it leaves out matters handled through nonjudicial punishment or administrative separation.

### How We Counted

Army courts-martial with trial dates in 2021–2026 that charged both Article 80 and Article 81 (14 cases), compared with all 210 Army Article 80 cases in those years.
