**Short answer:** The Army records hold 16 courts-martial from 2024 that charged Article 120c (indecent recording and exposure). The median confinement was 1.1 years, compared with 6 months in all Army cases in 2024\. A punitive discharge followed 91% of enlisted convictions, compared with 72% across the Army that year.

Based on 16 cases · 2024 · Army records · data updated October 24, 2026

## Confinement Longer Than the Army Median

Of the 16 cases, 14 ended in a conviction on at least one charge. Confinement was part of 13 of those sentences (93%). The median confinement was 1.1 years, longer than the 6 months median for all Army cases in 2024.

Among the sentences that included confinement, a quarter were 1.8 years or longer. These figures are adjudged sentences, set at trial before any plea-agreement cap, clemency, or appeal. Each sentence covers every charge in the case, not Article 120c alone.

## Article 120c Usually Came With Other Charges

Only 4 of the 16 cases charged Article 120c by itself. Article 120 (sexual assault) and Article 134 (general article) each appeared in 5 cases. Article 80 (attempt) appeared in 3, Article 128 (assault) in 2, and Article 131b (obstruction) in 1.

## Bad-Conduct and Dishonorable Discharges

A punitive discharge followed 91% of enlisted convictions: 7 bad-conduct discharges and 3 dishonorable discharges. The rate for all Army cases in 2024 was 72%. For officers, the equivalent of a punitive discharge is a dismissal. Of the 2 convicted officers or warrant officers, 1 was dismissed.

A sentence without a punitive discharge does not rule out a later administrative separation, which these records do not show.

## Pleas and Plea Agreements

Of the 16 accused, 11 pleaded guilty and 5 contested at least one charge. A contested case is one with a not-guilty or mixed plea. The contested share was 31%, compared with 27% in all Army cases in 2024.

All 11 guilty pleas are recorded with a plea agreement. Army records say whether an agreement existed, not what it said.

## Who Decided Guilt

The accused usually chooses whether a military judge alone or a panel of members decides guilt. The forum is listed for 15 cases. A military judge alone decided 14 of them (93%). Members heard 1 case, and that panel was made up of officers.

## Rank and Court Level

Among the accused with rank recorded, 9 were junior enlisted, 4 were NCOs, and 2 were officers. The group was more junior than all Army cases in 2024.

General courts-martial made up 81% of the cases (13 of 16), and special courts-martial made up the rest. A general court-martial can impose long confinement and a dishonorable discharge or dismissal. A special court-martial caps confinement at one year and cannot impose a dishonorable discharge.

## Rules That Changed at the End of 2023

Article 120c is a covered offense. Since December 28, 2023, special trial counsel, not commanders, decide whether to prosecute covered offenses. When every guilty finding in a case is for an offense after December 27, 2023, the military judge sets the sentence within new sentencing parameters.

Both rules depend on the offense date. The records give trial dates only, so the 2024 cases mix cases tried under the old rules and the new rules. The records cannot show whether either change affected these figures.

## What the Records Leave Out

The records show charges, pleas, findings, and sentences. They do not show the evidence, the terms of plea agreements, or conduct handled by nonjudicial punishment or administrative separation.
