**Short answer:** 12 Army courts-martial from 2021–2026 charged both Article 108, military property, and Article 121, larceny. All 12 ended in a conviction, 10 of the accused pleaded guilty, and the median confinement was 6 months, close to the 5 months for all Army Article 108 cases.

Based on 12 cases · 2021–2026 · Army records · data updated October 24, 2026

## Guilty Pleas Were the Usual Result

10 of the 12 accused pleaded guilty. 2 contested at least one charge by entering a not-guilty or mixed plea. The contested share was 17%, compared with 14% in Army Article 108 cases overall.

9 of the 10 guilty pleas are recorded with a plea agreement, and 1 has no entry. Army records say whether an agreement existed, not what it contained.

## Confinement in Nearly Every Sentence

All 12 cases ended in a conviction on at least one charge. 11 of the 12 sentences included confinement (92%). The median confinement was 6 months, and a quarter of the terms were 9 months or longer. For Army Article 108 cases overall, the median was 5 months.

These are adjudged sentences. They reflect the trial result before any plea-agreement cap, clemency, or appeal, and they cover every charge in the case.

## Punitive Discharges

All 12 convicted were enlisted members. 7 of them (58%) received a bad-conduct or dishonorable discharge, and 1 of the 7 was dishonorable. Across Army Article 108 cases overall the rate was 62%, so a punitive discharge was less common here. A sentence without a punitive discharge does not rule out a later administrative separation.

## NCOs Were Most of the Accused

NCOs made up 67% of the accused and junior enlisted members (E-1 to E-4) made up 33%. No officers appear. Across Army Article 108 cases overall, junior enlisted members were 44% of the accused.

## Other Charges in These Cases

Article 108 was never the only charge here. In all Army Article 108 cases in 2021–2026, 6 of 36 charged it alone. Besides Article 121, the companion charges were Article 92, orders violation, in 4 cases; Article 107, false official statement, in 4; Article 134, the general article, in 3; and Article 131b, obstruction, in 2.

## Court Level and Forum

6 cases were general courts-martial and 6 were special courts-martial. The general share, 50%, was lower than the 58% for Army-wide Article 108 cases. A special court-martial caps confinement at one year.

A military judge alone decided 10 cases, and enlisted panels decided 2\. Members heard 17% of these cases, compared with 6% of Army-wide Article 108 cases. The accused usually chooses the forum.

## When the Trials Took Place

The trials ran from April 2021 to February 2026: 6 in 2021, 1 in 2022, 2 in 2023, 0 in 2024, 2 in 2025, and 1 in 2026, a partial year. Army records in this data are sparse before 2021.

## Limits of This Data

The records give trial dates, not offense dates. They do not describe the evidence or the plea terms. They also leave out cases handled by nonjudicial punishment or administrative separation, so they show only the property and larceny cases that reached a court-martial.

### How We Counted
